Terms and Conditions

1. Scope

These Terms and Conditions apply to all contracts between sandracreates and its clients, unless otherwise agreed in writing.

2. Services

sandracreates provides services in the following areas:

Social Media Management
Content Creation (e.g. photo, video, graphics)
Marketing Support
Website Design / Web Development
Flyers, Logos, Branding, and related design services

The specific scope of services is defined individually in each offer or contract.

3. Offers & Contract Conclusion

3.1 Offers made by sandracreates are non-binding unless explicitly stated otherwise.
3.2 The contract is concluded once sandracreates confirms the offer in writing (e.g. by e-mail) or begins performing the service.

4. Prices & Payment Terms

4.1 All prices are net prices (plus applicable VAT), unless otherwise stated.
4.2 Payments must be made within 7 days after receiving the invoice without deduction, unless another deadline has been agreed.
4.3 In case of late payment, sandracreates may charge interest on arrears and reminder fees.
4.4 For longer projects, a partial payment (e.g. 30% upon order confirmation) may be required.

5. Client Obligations

The client agrees to provide all necessary information, materials, texts, and images in a timely manner to enable the execution of the project.
Delays caused by missing materials or feedback will extend the project timeline accordingly.

6. Retention of Ownership & Usage Rights

6.1 All created works (designs, graphics, content) remain the property of sandracreates until full payment has been received.
6.2 Upon full payment, sandracreates grants the client the contractually agreed usage rights.
6.3 Any further use (e.g. resale, mass reproduction, or modification beyond the agreed scope) requires written approval.

7. Revision Rounds

Each project generally includes one or two revision rounds (unless otherwise agreed). Additional revisions will be billed separately.

8. Cancellation / Withdrawal

8.1 Cancellation before the start of the project is free of charge.
8.2 After the project has started, services already provided will be invoiced proportionally.
8.3 If the client cancels the project without a valid reason, up to 50% of the agreed fee may be charged as a cancellation fee, unless otherwise agreed in writing.

9. Liability

9.1 sandracreates is liable only for damages caused by gross negligence or intent.
9.2 No liability is assumed for indirect damages, loss of profit, data loss, or consequential damages, to the extent permitted by law.
9.3 In any case, liability is limited to the amount paid by the client for the respective service.

10. Withdrawal by sandracreates

If sandracreates is unable to perform the service (e.g. due to illness or force majeure), the client will be informed immediately, and any payments already made will be refunded.

11. Data Protection

sandracreates processes personal data in accordance with applicable data protection laws (GDPR).

12. Final Provisions

12.1 If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions remains unaffected.
12.2 Changes or additions to the contract must be made in writing.
12.3 The place of jurisdiction is Regensburg, Germany.
